Welcome to AutismLinkage, a platform operated by AutismLinkage, Inc. that provides AI-powered tools and services to support behavioral intervention for individuals with autism (collectively, the "Service"). These Terms of Service ("Terms") govern your access to and use of our Service. By accessing or using the Service, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you should discontinue use of the Service immediately. In addition to these Terms, we have adopted the AutismLinkage Privacy Policy. Please read our Privacy Policy carefully for information relating to our collection, use, and disclosure of your personal information.

User Eligibility

Our Service is designed for use by parents, guardians, Board Certified Behavior Analysts (BCBAs), Registered Behavior Technicians (RBTs), and other qualified professionals working with children with autism. We are subject to the Children's Online Privacy and Protection Act ("COPPA"), which requires that we obtain verifiable parental consent before we collect personally identifiable information online from children who are under 13.

We only collect personal information from children under 13 where that child's parent or authorized legal guardian has provided consent. If you are a child under 13, please do not send any personal information about yourself to us if your parent or guardian has not expressly consented.

You represent and warrant that:

• You are of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Service)
• If you're agreeing to these Terms on behalf of an organization (such as a clinic or educational institution), you are authorized to bind that organization to these Terms
• You will comply with all applicable laws and regulations in your use of the Service

Creating an Account

To use the Service, you must create an account ("Account") by providing certain personal information such as your name, email address, and professional credentials (if applicable). You may also provide additional information about the children you work with to help us tailor the Service to your needs.

You are responsible for:

• Ensuring that all personal information you provide is accurate and up to date
• Creating a secure password and protecting your Account from unauthorized access
• All activity that occurs under your Account
• Notifying AutismLinkage immediately if you believe your Account has been compromised

Fees and Payment

Creating a basic Account may be free. However, AutismLinkage charges fees for certain premium features and services. If you choose to purchase or subscribe to such features, you agree to pay all applicable fees.

You represent and warrant that:

• The payment information you provide is true, correct, and complete
• You are authorized to use the payment method provided
• Charges incurred by you will be honored by your financial institution
• You will pay all charges at the posted prices, including applicable taxes

Prices are subject to change without notice. We reserve the right to modify our pricing structure at any time.

Permitted Use of the Service

You agree that you will not use the Service for any purpose other than as described in these Terms. Specifically, you may not:

• Use the Service in any way that infringes any patent, trademark, copyright, or other intellectual property rights
• Use the Service for any unlawful, harmful, threatening, abusive, harassing, or fraudulent purpose
• Transmit any unauthorized advertisements, spam, or unsolicited commercial communications
• Transmit any harmful computer codes, viruses, or malware
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated tools to crawl, scrape, or index the Service
• Impersonate any person or entity, including AutismLinkage employees or representatives
• Interfere with the proper functioning of the Service or other users' access to the Service

AutismLinkage reserves the right to deny access to the Service to any user, at any time, for any reason or no reason, without notice.

AI-Powered Features

Our Service includes AI-powered tools designed to assist with behavioral intervention planning, data analysis, and progress tracking. By using these features, you acknowledge that:

• AI-generated recommendations are for informational purposes only and should not replace professional clinical judgment
• You are responsible for reviewing and validating all AI-generated content before implementing recommendations
• AI features are continuously being improved and may occasionally produce inaccurate results
• You will use AI features responsibly and in accordance with professional standards and ethical guidelines

Data and Content

Your Content

You retain ownership of any content, data, or information you submit to the Service ("Your Content"). By submitting Your Content, you grant AutismLinkage a worldwide, non-exclusive, royalty-free license to use, store, and process Your Content solely for the purpose of providing and improving the Service.

Data Privacy and Security

We take the privacy and security of your data seriously. All data is encrypted in transit and at rest. We implement industry-standard security measures to protect your information. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

HIPAA Compliance

If you are a covered entity or business associate under HIPAA, you are responsible for ensuring that your use of the Service complies with HIPAA requirements. AutismLinkage offers Business Associate Agreements (BAAs) for eligible customers.

Intellectual Property Rights

All content included in the Service, including text, graphics, logos, software, and algorithms, is the property of AutismLinkage or its licensors and is protected by United States and international copyright laws.

You may not:

• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without our express written consent
• Reverse engineer, decompile, or disassemble any software or algorithms used in the Service
• Use our trademarks, logos, or branding without authorization
• Create derivative works based on the Service

The Service may contain links to third-party websites or services, including payment processors. AutismLinkage does not endorse, control, or assume responsibility for any third-party content or services. You access third-party links at your own risk and should review their terms and privacy policies.

Parental Consent and Children's Privacy

Before any child's information is collected through the Service, we require explicit parental or guardian consent. Parents and guardians are responsible for:

• Monitoring their child's use of any child-facing features
• Ensuring that any information shared complies with our Terms
• Understanding how their child's information will be used and protected

User Responsibilities

As a professional user (BCBA, RBT, or other qualified professional), you are responsible for:

• Using the Service in accordance with professional standards and ethical guidelines
• Maintaining appropriate clinical oversight of all interventions
• Ensuring that AI-generated recommendations are reviewed and validated before implementation
• Complying with all applicable laws, including HIPAA and state licensing requirements
• Maintaining appropriate liability insurance

Indemnification

You agree to indemnify and hold harmless AutismLinkage, its parent, subsidiaries, affiliates, directors, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your professional services provided to clients

Disclaimer of Warranties

AutismLinkage does not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained from the Service will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTISMLINKAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL AUTISMLINKAGE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO AUTISMLINKAGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $500, WHICHEVER IS GREATER.

Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Termination

AutismLinkage may terminate or suspend your access to the Service at any time, for any reason, including if we believe you have violated these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You must cease all use of the Service
• Certain provisions of these Terms will survive termination, including those related to intellectual property, disclaimers, and limitations of liability

Refund Policy

AutismLinkage may issue partial or full refunds at its sole discretion. Refund requests must be submitted within 30 days of purchase. After this period, the company is under no obligation to process refund requests. All refunds are subject to review and approval.

Modifications to Terms

AutismLinkage may modify these Terms from time to time. When we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such notification constitutes your acceptance of the modified Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Santa Clara County, California.

Any claim or cause of action you have with respect to the Service must be commenced within one (1) year after the claim arises.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations within 30 days, either party may pursue other remedies.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and AutismLinkage regarding the Service and supersede all prior agreements and understandings.

Assignment

You may not assign or transfer these Terms without AutismLinkage's prior written consent. AutismLinkage may assign or transfer these Terms without restriction.

No Waiver

The failure of AutismLinkage to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
